Terms of Service

The agreement between you and Everykept. Plain language where the law allows it.

1. Agreement

These terms are a contract between you and TiqyTech Inc. (“Everykept”, “we”). By creating an account or using the service you accept them, together with our Privacy Policy. If you use Everykept for a business, you confirm you have authority to bind that business, and “you” includes it.

2. Eligibility

You must be at least 18 and able to enter a contract. You must provide accurate account information and keep your login to yourself. You are responsible for everything done through your account, so tell us immediately if you suspect it has been compromised.

3. What Everykept does

Everykept displays financial account information retrieved through Plaid, lets you categorize and annotate transactions, attach receipt files, set budgets and view monthly summaries. Everykept is a read-only record-keeping tool. It does not move money, pay bills, execute transactions or hold funds.

4. Bank connections and Plaid

Linking a financial institution uses Plaid Inc.’s services. You authorize Plaid to access your account information on your behalf and transmit it to us, and you agree to the Plaid End User Privacy Policy. Your institution may impose its own terms. We do not control your institution or Plaid and are not responsible for their availability, accuracy or conduct.

5. Not financial, tax or legal advice

Balances, transactions, categories and summaries are shown as received and as you edit them. They may be delayed, incomplete or wrong. Everykept does not provide financial, tax, accounting or legal advice, and nothing in the service is a substitute for your bank’s records or a qualified professional. Confirm figures with your institution before relying on them.

6. Your content

Receipts, notes and other content you upload remain yours. You grant us a licence to store, process (including compressing images and removing embedded metadata), display and back up that content solely to provide the service to you. You confirm you have the right to upload it and that it does not contain content belonging to someone else without permission.

7. Acceptable use

You agree not to:

  • connect accounts you are not authorized to access;
  • attempt to access another user’s data, probe or circumvent our security, or run automated scraping against the service;
  • upload malware or unlawful content;
  • resell or white-label the service without a written agreement.

8. Fees

Everykept is currently free for individual use. If we introduce paid plans we will give at least 30 days’ notice, and any plan you are on stays free until you choose to upgrade. Fees, when introduced, are stated in Canadian dollars unless shown otherwise and are exclusive of applicable taxes.

9. Availability and changes

We aim for the service to be available continuously but do not guarantee it. We may change, suspend or retire features. If we discontinue the service entirely we will give at least 60 days’ notice and a way to export your data, including your receipts.

10. Ending the agreement

You can delete your account at any time in Settings. We may suspend or terminate accounts that violate these terms, create legal or security risk, or remain unverified for 30 days. On termination your data is handled as described in the Privacy Policy.

11. Disclaimers

The service is provided “as is” and “as available”. To the extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and any warranty that data will be accurate, complete or uninterrupted.

12. Limitation of liability

To the extent permitted by law, Everykept and its operators will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the service. Our total liability for any claim is limited to the greater of the fees you paid us in the 12 months before the claim and CAD $100. Some jurisdictions do not allow these limits, in which case they apply to the maximum extent permitted.

13. Indemnity

If you use the service for a business, that business will defend and indemnify Everykept against third-party claims arising from its content or its breach of these terms.

14. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. Disputes will be resolved in the courts of Ontario, without prejudice to any consumer protection rights you have in your home jurisdiction that cannot be waived.

15. Changes to these terms

We may update these terms. For material changes we will email you and show a notice in the app at least 30 days before they take effect. Continuing to use the service after that date means you accept the new terms.
